Pre-Employment Drug Testing: How to Set Up a Program

Pre-employment drug testing helps employers hire safely, and instant urine cups make it fast and affordable to do on site. Here is how to set up a program that is consistent and legally sound.

1. Write the policy first

  • Which positions are tested (all positions, or safety-sensitive roles only).
  • When the test happens, usually after a conditional job offer.
  • What the test screens for, and the cutoff levels.
  • How preliminary positives are confirmed, and how prescriptions are handled.
  • What happens after a confirmed positive or a refusal.

Tell candidates about the testing requirement in the job posting or offer letter, and get written consent before testing.

2. Check the laws that apply to you

Drug testing laws vary by state and city, and they change often, especially for marijuana. Several states and cities now limit how employers can use pre-employment THC results, for example by restricting testing for marijuana or protecting off-duty use for many positions, with exceptions for safety-sensitive roles. Some states also require specific procedures or lab confirmation. Review current state and local law, or ask an employment attorney, before you start.

Federally regulated positions, such as commercial drivers under DOT rules, must be tested by a certified laboratory. Instant cups cannot be used for those tests.

3. Choose a test

Most employers use a 10 panel or 12 panel CLIA waived cup. If your policy includes PCP, use the 12 panel with PCP. See what each panel detects and what CLIA waived means.

4. Run consistent collections

5. Confirm before you decide

Send every preliminary positive to a laboratory for confirmation before withdrawing an offer, and give the candidate a chance to disclose prescriptions. Keep results confidential and separate from personnel files.
